All Things Cancer + Wellness Expo Photography Terms and Conditions

By downloading and using photographs provided by the All Things Cancer + Wellness Expo (“Photo(s)”), you agree to the following guidelines (“Terms & Conditions”). The Byrd Cancer Education & Advocacy Foundation reserves the right to require immediate removal or modification of any Photos at any time if they are not used in compliance with these Terms & Conditions.
Quitclaim Basis
All Photos are provided on a quitclaim basis, and the All Things Cancer + Wellness Expo makes no representations, warranties, or indemnities of any kind in connection with the Photos.
Use of Photos
Photos may be used in the following ways:
Editorial Purposes
- Includes publications in magazines, newspapers, blogs, or websites to describe the All Things Cancer + Wellness Expo or related activities.
Limited Promotional Purposes (Non-Commercial)
- Includes usage that promotes your participation in the Expo but excludes any advertising, sponsorship, or sales-oriented calls to action.
Photos CANNOT be used for:
- Commercial purposes, including advertisements, sponsorships, or product packaging.
- Endorsements or any material that implies a connection to or approval by the All Things Cancer + Wellness Expo without prior written consent.
- Any purpose that requires a purchase by an end user or suggests the All Things Cancer + Wellness Expo endorses a business or individual.
Credit
The photographer must be credited whenever and wherever the Photo is published, as follows:
- A clear, legible credit line must accompany all uses in print, web, social media, or other platforms.
- Preferred example: “Photo credit: [Photographer’s Name].”
- On social media, the camera emoji may replace “Photo credit:” if desired.
- To identify the photographer contact [email protected] if you are unsure of the credit details.
Rights
The rights to use Photos provided by the All Things Cancer + Wellness Expo are not sublicensable, assignable, or transferable in any manner.
- The All Things Cancer + Wellness Expo does not grant any rights, permissions, or clearances to use the name, likeness, or image of individuals depicted in the Photos or the trademarks of brands visible in the Photos. You are responsible for obtaining all necessary rights, permissions, and clearances before using the Photos.
- Expo trademarks (including the All Things Cancer + Wellness Expo) may only be used incidentally as they appear in the Photos and cannot be added through editing or other means.
Indemnity and Liability
You agree to indemnify and hold harmless the All Things Cancer + Wellness Expo, the Byrd Cancer Education & Advocacy Foundation, and their affiliates, officers, employees, and representatives from any third-party claims, losses, damages, or liabilities arising from your breach of these Terms & Conditions. This indemnity obligation survives the termination of these Terms & Conditions.
Choice of Law
These Terms & Conditions are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law principles.
Updates to Terms
The All Things Cancer + Wellness Expo reserves the right to modify these Terms & Conditions at any time. Updates will be posted on the Expo’s website, and continued use of the Photos constitutes acceptance of the updated Terms & Conditions.
General Provisions
- These Terms & Conditions do not create an agency, partnership, or employment relationship between the parties.
- If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
- Headings are included for organizational purposes only and do not affect the interpretation of these Terms & Conditions.
By downloading or using any Photos provided by the All Things Cancer + Wellness Expo, you acknowledge that you have read, understood, and agreed to these Terms & Conditions. You confirm that your use of the Photos will not violate any third-party rights or applicable laws.
